OpenGate operates as a payment gateway: it provides payment processing technology and connects merchants to acquiring services. OpenGate does not provide legal, tax, licensing or marketing services.
2. Purpose of this website
This website presents information about OpenGate’s services for high-risk merchants. The content, including the guides and industry pages, is provided for general information only. It does not constitute an offer of payment services, legal advice, financial advice or a recommendation. Nothing on this website creates a contractual relationship between you and OpenGate.
3. Offers are made in writing
Sending an application or a message through this website does not create an agreement. Payment terms, including rates, reserves, settlement schedules and limits, exist only in a written offer issued by OpenGate after underwriting. No employee statement, website text or email exchanges modify a written offer. Fees apply only once you accept a written offer and begin onboarding.
4. Underwriting and approvals
Every application is underwritten individually. OpenGate may decline an application for any lawful reason, and a decline does not obligate OpenGate to disclose its full criteria. Submitting false or misleading documents terminates any application or agreement. Response times stated on this website, such as a reply within 1 business day, are service targets and not contractual guarantees.
5. Compliance with law
Merchants remain responsible for their own legal compliance, including licenses, permits, consumer protection rules, tax registration and any other regulatory obligations in the jurisdictions where they operate. OpenGate may suspend or terminate processing where it has reason to believe a merchant’s activity is unlawful or in breach of card scheme rules.
6. Intellectual property
The OpenGate name, logo, texts, design and materials on this website are protected. You may not reproduce the site’s content for commercial purposes without written permission. You may link to any public page.
7. Limitation of liability
To the maximum extent permitted by law, OpenGate is not liable for indirect, incidental or consequential damages arising from the use of this website, including decisions made based on its informational content.
