The products are legal. The billing model is the risk. Trial and auto-ship offers are commonly coded as negative-option merchants under MCC 5968, a category the card schemes ask acquirers to register and monitor. Their rules call for clear terms at checkout, a reminder before the first full charge and an easy way to cancel, and processors that cannot run those rules refuse the category rather than build the capability.

How we underwrite a supplement merchant account
The file starts with the funnel.
